1. Agreement

These Terms of Service (the “Terms”) are a binding agreement between you and The Visa App Inc. (“Company,” “we,” “us,” or “our”), a corporation, regarding the website located at https://thevisa.app and related pages, quizzes, directories, accounts, chat features, and Store (collectively, the “Service” or “thevisa.app”).

By accessing or using the Service, you agree to these Terms, the Privacy Policy, and the Refund & Cancellation Policy of The Visa App Inc.

If you do not agree, do not use the Service. All rights not expressly granted to you are reserved by The Visa App Inc.

2. Who we are & what the Service is

The Visa App Inc. operates thevisa.app as a free information and matching platform. The Service helps people discover visa, residency, and e-residency pathways and connect with independent, licensed immigration lawyers and law firms (“Legal Professionals”).

• Free for users: quizzes, country information, lawyer directory browsing, and matching tools. Free accounts may unlock a free initial consultation benefit as described on the site — that benefit is still not legal advice from The Visa App Inc.
• Legal Professionals may pay listing or subscription fees to appear on the platform. The Visa App Inc. does not take a cut of legal fees, government fees, Citizenship by Investment (CBI) donations/investments, or wires paid to third parties.
• You engage lawyers directly. Any retainer, advice, or filing is solely between you and that Legal Professional. The Visa App Inc. is not a party to those engagements and is not responsible for their quality, availability, or outcomes.
• Store: the only consumer paid item currently offered on the site is a clearly labeled $5 test product processed by Stripe for payment-flow testing. It is not a visa, legal service, or consultation package.

This is not legal, tax, or immigration advice. Match scores, fee ranges, timelines, and program summaries are informational estimates only, may be incomplete or out of date, and are provided by The Visa App Inc. solely as general information—not as professional advice.

3. Eligibility & accounts

You must be at least 18 (or the age of majority where you live) to create an account. Authentication may be provided by Clerk or similar third parties. You are responsible for activity under your account and for keeping credentials secure.

The Visa App Inc. may suspend or terminate accounts that are abusive, fraudulent, or in breach of these Terms or law, with or without notice as permitted by law.

4. No attorney–client relationship with The Visa App Inc.

The Visa App Inc. is not a law firm, is not licensed to practice law, and does not provide legal, tax, or immigration advice. Use of the Service—including quizzes, chat tools, consultation codes, lawyer matches, fee tables, and program summaries—does not create an attorney–client, fiduciary, or advisor–client relationship with The Visa App Inc. or any of its officers, directors, employees, or agents.

An attorney–client relationship may form only with a Legal Professional you independently engage, under that professional’s engagement letter and ethical rules. The Visa App Inc. does not supervise Legal Professionals’ legal work and does not guarantee any result.

This is not legal advice. Do not rely on thevisa.app as a substitute for licensed counsel.

5. Independent Legal Professionals

Legal Professionals listed on thevisa.app are independent third parties. They are not employees, partners, joint venturers, or agents of The Visa App Inc. solely by reason of listing or receiving leads.

The Visa App Inc. does not endorse any particular Legal Professional, does not warrant their credentials beyond tools that help you research publicly described profiles, and is not liable for their acts, omissions, advice, fees, or misconduct. Disputes with Legal Professionals must be resolved with them, not with The Visa App Inc., except as may be required by law for our own platform operations.

6. Content, fees & third parties

Government fees, legal fee ranges, timelines, dual-citizenship notes, and program descriptions are estimates or summaries unless labeled as a direct official quote. Rules change. Always re-check official sources before applying or paying anyone.

The Service may link to government sites, Stripe Checkout, Cloudflare, Clerk, analytics, messaging apps, CDNs, and Legal Professionals’ websites. Their terms and privacy policies apply. The Visa App Inc. is not responsible for third-party content, availability, or security practices.

7. User conduct

You agree not to misuse the Service (including scraping in violation of robots/rules, harassment, fraud, uploading malware, impersonation, or unlawful content). Legal Professionals must hold required licenses and market services truthfully.

8. Payments

Consumers: free matching and informational tools have no charge from The Visa App Inc. If you purchase the $5 test product in the Store, payment is processed by Stripe under the Refund & Cancellation Policy of The Visa App Inc.

Legal Professionals: listing/subscription fees (if offered) are billed as described at signup or on For Lawyers pages. Unless stated otherwise, fees are non-refundable for completed billing periods.

The Visa App Inc. does not collect or store full card numbers on its servers; Stripe handles card data under PCI-compliant systems.

9. Intellectual property & reservation of rights

The visa.app name, branding, layout, software, and original content are owned by The Visa App Inc. or its licensors. You may not copy the Service for commercial reuse without prior written permission from The Visa App Inc.

You retain rights in content you submit and grant The Visa App Inc. a worldwide, non-exclusive, royalty-free license to host, process, and display that content as needed to operate and improve the Service.

The Visa App Inc. reserves all rights not expressly granted in these Terms.

10. Disclaimers (as-is / as-available)

To the maximum extent permitted by applicable law, the Service—including all content, matches, scores, fee estimates, chat features, consultation codes, and third-party listings—is provided by The Visa App Inc. strictly on an “as is,” “as available,” and “with all faults” basis, without any warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, availability, or quiet enjoyment.

The Visa App Inc. does not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that any immigration, tax, or investment outcome will be achieved.

This is not legal advice. Denied visas, investment losses, tax consequences, relocation costs, and disputes with Legal Professionals or governments are outside the control of The Visa App Inc.

11. Limitation of liability

To the maximum extent permitted by law:

• The Visa App Inc. and its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, lost data, lost business opportunities, cost of substitute services, relocation costs, denied applications, investment losses, or reputational harm—even if advised of the possibility of such damages.
• The total aggregate liability of The Visa App Inc. and the foregoing persons for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amounts you paid to The Visa App Inc. for the Service in the twelve (12) months immediately before the claim, or (b) USD $100 if you paid The Visa App Inc. nothing.

These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and form an essential basis of the bargain. Nothing in these Terms excludes liability that cannot be limited under applicable law (including certain non-waivable consumer rights in the EU/UK).

12. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The Visa App Inc. and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Service; (b) your content; (c) your breach of these Terms or applicable law; (d) your interactions or contracts with Legal Professionals or other users; or (e) if you are a Legal Professional, your professional services, advertising, or credentials.

This section does not apply where indemnification is prohibited for consumers under mandatory local law.

13. Governing law & venue

Except where mandatory consumer law requires otherwise, these Terms and any dispute arising out of the Service are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Subject to any non-waivable rights of consumers in their country of residence, the state and federal courts located in Miami-Dade County, Florida, shall have exclusive jurisdiction, and you consent to personal jurisdiction there.

EEA/UK consumers may rely on mandatory protections of their country of residence and may be entitled to bring proceedings in the courts of that country.

14. Changes; termination; miscellaneous

The Visa App Inc. may modify these Terms or the Service at any time. Material changes will be posted on this page with an updated “Last updated” date and, where required by law, may be communicated by email or in-product notice. Continued use after the effective date constitutes acceptance of the revised Terms, except where additional consent is mandatory.

The Visa App Inc. may suspend or terminate access for breach, legal risk, or to protect users or the Service. You may stop using the Service at any time.

If any provision is unenforceable, it will be modified to the minimum extent necessary; the remainder remains in effect. Failure to enforce is not a waiver. These Terms are the entire agreement between you and The Visa App Inc. regarding the Service (except separate signed enterprise or listing agreements). You may not assign these Terms without our consent; The Visa App Inc. may assign to an affiliate or successor.

Sections that by nature should survive (including disclaimers, liability limits, indemnity, IP, and governing law) survive termination.

2. Data we collect

• Quiz & matching inputs: answers you provide (goals, nationality, budget bands, languages, household size, optional priority flags). Some answers may be sensitive if you choose to provide them.
• Usage data: pages viewed, device/browser type, approximate location from IP, referrer, and diagnostic logs.
• Communications: messages you send via contact forms, match requests, or support email.
• Payments (Store only): if you buy the $5 test product, Stripe processes payment data. The Visa App Inc. receives limited metadata (e.g., payment success, session id), not full card numbers.

3. How The Visa App Inc. uses data

4. Sharing

• Legal Professionals: when you request a match or share contact details, the lawyer may receive your name, email, and relevant case context you submit. They become an independent controller of that data for their practice. The Visa App Inc. is not responsible for how they process data after lawful disclosure at your request.
• Service providers: Cloudflare (hosting/CDN/security), Clerk (auth), Stripe (Store payments only), and email/infrastructure vendors as needed, under contracts limiting use to instructions of The Visa App Inc. where required.
• Legal: if required by law, court order, or to protect rights, safety, or property of The Visa App Inc. or others.

5. Cookies & similar tech

The Visa App Inc. uses essential cookies/storage for security, session, and preferences. Analytics cookies (if enabled) help understand aggregate traffic and may require consent where law requires it. You can clear localStorage and cookies in your browser.

6. Retention

The Visa App Inc. keeps account and lead data while your account is active and for a reasonable period afterward for security, disputes, and legal obligations, then deletes or anonymizes when no longer needed. Browser localStorage remains until you clear it.

7. Your rights

Depending on where you live (including GDPR / UK GDPR / California CPRA), you may have rights to access, correct, delete, export, restrict, or object to certain processing, and to withdraw consent. California residents may have rights to know, delete, correct, and opt out of “sale” or “sharing” as defined by law (The Visa App Inc. does not sell personal information for money).

8. Children

The Service is not directed to children under 16 (EU/UK) or under 13 (US). The Visa App Inc. does not knowingly collect personal data from children. Contact us to delete any such data if discovered.

9. International transfers

The Visa App Inc. may process data in the United States and other countries where its providers operate. Where required, appropriate safeguards (such as standard contractual clauses) are used for transfers from the EEA/UK.

10. Security

The Visa App Inc. uses reasonable technical and organizational measures (HTTPS, access controls, reputable processors). No method of transmission or storage is 100% secure. THE SERVICE IS PROVIDED WITHOUT GUARANTEE OF PERFECT SECURITY.

1. Free services (no charge)

The following are free and have no payment and no refund because no money is charged by The Visa App Inc.:

• Browsing countries, e-residency information, CBI programme summaries, and guides
• Find My Visa quiz and match results
• Lawyer directory browsing and free matching tools
• Free account signup and free consultation codes / free 30-minute consultation benefits described on thevisa.app (benefits of free membership; The Visa App Inc. does not bill you for them)
• Demo or informational chat features that do not process a card payment

Fees charged by a Legal Professional under their own engagement letter are not refunded by The Visa App Inc.—contact that lawyer or firm. The Visa App Inc. has no liability for third-party professional fees or outcomes.

2. $5 Store test product (only paid consumer item)

The Store currently offers a single consumer product: the Visa Pathway Test Pack at USD $5.00, labeled as a test product for trying Stripe Checkout on thevisa.app. It is not a visa application, legal service, consultation package, or investment product, and is not advice from The Visa App Inc.

• Payments are processed by Stripe. Card data is handled by Stripe, not stored as full PAN on servers of The Visa App Inc.
• Refunds: If you purchased the $5 test product by mistake, or the Checkout payment succeeded but you received no confirmation of a completed test purchase, email [email protected] within 14 days of the charge with your email used at Checkout and approximate time of purchase. The Visa App Inc. will refund eligible mistaken or duplicate charges to the original payment method via Stripe, typically within 5–10 business days after approval (bank timing varies).
• Test-mode charges (using Stripe test keys / test cards such as 4242…) are not real money and do not require a refund.
• Chargebacks: Please contact The Visa App Inc. before filing a dispute so we can resolve quickly. Fraudulent disputes may result in account suspension.

Except as expressly stated in this Policy, all sales processed for The Visa App Inc. are final to the maximum extent permitted by law. Nothing in this Policy creates an attorney–client relationship with The Visa App Inc. This is not legal advice.

3. Lawyer / firm listing subscriptions

If you are a Legal Professional paying listing or subscription fees to The Visa App Inc.:

• Fees are generally billed in advance for the subscription period shown at purchase.
• Unless a separate written order form with The Visa App Inc. says otherwise, fees for a period that has already started are non-refundable.
• You may cancel future renewals by contacting [email protected] before the next renewal date; access continues through the paid period already purchased.

4. What The Visa App Inc. never refunds

• Money you paid to lawyers, governments, banks, or CBI programme operators (third-party transactions)
• Outcomes of visa applications, residency filings, or investments
• Dissatisfaction with free informational content or match rankings (no fee was charged by The Visa App Inc.)

5. How to request a refund
